Welcome to Lumi Buddy (“Lumi Buddy,” “we,” “our,” or “us”). Lumi Buddy is an AI companion service operated by Lumi AI, a business registered in Thailand.

These Terms of Service (“Terms”) govern your access to and use of the Lumi Buddy mobile application, website, and any related features, services, content, and technologies (collectively, the “Services”).

Lumi Buddy is an AI companion designed to provide personalized conversations, memory features, emotional support, entertainment, productivity assistance, and other AI-powered experiences. While Lumi Buddy is designed to simulate natural conversations and build long-term interactions, it is not a human being and should not be considered a substitute for professional advice or real-life relationships.

By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access or use the Services.

These Terms constitute a legally binding agreement between you and Lumi Buddy.

By accessing, registering for, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms or any future modifications, you must discontinue your use of the Services immediately.

You represent and warrant that you have the legal capacity to enter into this agreement. If you are using the Services on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

We may update or modify these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When material changes are made, we will update the “Last Updated” date at the beginning of these Terms and may provide additional notice where required by applicable law.

Your continued use of the Services after any revised Terms become effective constitutes your acceptance of the updated Terms.

To use the Services, you must be at least 13 years of age. If you are under the age of 18 (or the age of majority in your jurisdiction), you may use the Services only with the consent and supervision of a parent or legal guardian, where permitted by applicable law.

To access certain features of the Services, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information during registration and to keep your account information current at all times.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Lumi Buddy immediately if you become aware of any unauthorized access to or use of your account.

You may not create an account using false information, impersonate another person or entity, or create an account on behalf of someone else without proper authorization.

We reserve the right to suspend, restrict, or terminate your account if any information you provide is inaccurate, misleading, fraudulent, or if your account is used in violation of these Terms or applicable law.

As a user of the Services, you agree to use Lumi Buddy responsibly and in accordance with these Terms and all applicable laws and regulations.

You are responsible for all activities conducted through your account and for ensuring that your use of the Services does not infringe upon the rights of others or interfere with the operation, security, or integrity of the Services.

You are responsible for evaluating the accuracy, completeness, and usefulness of any information or responses generated by the AI. While Lumi Buddy strives to provide helpful and engaging interactions, AI-generated content may be inaccurate, incomplete, outdated, or inappropriate in certain circumstances.

You agree not to rely solely on AI-generated responses when making important personal, medical, legal, financial, or other significant decisions. You remain solely responsible for your actions and decisions based on your use of the Services.

Failure to comply with these responsibilities may result in the suspension or termination of your access to the Services.

Lumi Buddy is an AI-powered companion platform designed to provide personalized conversations and interactive experiences. The Services may include AI chat, long-term memory, voice interactions, image generation, relationship progression, personalization features, and other functionalities that may be introduced from time to time.

The Services are intended to provide companionship, entertainment, productivity assistance, and general informational support. Features and functionality may vary depending on your subscription plan, device compatibility, geographic location, or service availability.

We continuously improve and update the Services to enhance user experience. As a result, we may add, modify, suspend, or discontinue certain features or functionalities at any time, with or without prior notice, where permitted by applicable law.

While we strive to provide reliable and high-quality Services, we do not guarantee that all features will be available at all times or that the Services will operate without interruption, delay, or technical errors.

Lumi Buddy is an artificial intelligence (“AI”) companion designed to simulate natural conversations and provide personalized interactions. Although the Services are intended to create engaging and meaningful experiences, Lumi Buddy is not a human being, does not possess emotions, consciousness, personal beliefs, or independent judgment, and should not be interpreted as having genuine feelings or intentions.

Responses generated by the AI are created automatically based on machine learning models and available information. As a result, AI-generated responses may be inaccurate, incomplete, misleading, outdated, or inappropriate in certain circumstances. Lumi Buddy does not guarantee the accuracy, reliability, or completeness of any AI-generated content.

The Services are provided for companionship, entertainment, productivity assistance, and general informational purposes only. They are not intended to replace professional advice, diagnosis, treatment, counseling, legal services, financial advice, or other professional consultation. You should always seek qualified professional assistance when making important decisions or addressing matters that require professional expertise.

By using the Services, you acknowledge and agree that you are solely responsible for evaluating and relying upon any information or suggestions generated by the AI.

Lumi Buddy may use AI memory and personalization features to provide a more consistent, relevant, and personalized user experience. These features may allow the AI to remember information you choose to share, such as your preferences, interests, conversation history, goals, and other details that help improve future interactions.

AI memory is intended to enhance conversations and personalization, but it is not guaranteed to be complete, accurate, or permanent. The AI may forget, misinterpret, summarize incorrectly, or fail to recall previously shared information. Memory availability and functionality may also vary depending on your subscription plan, device, technical limitations, or future updates to the Services.

You are responsible for reviewing the information you choose to share with the AI and should avoid relying on AI memory for important records or critical information. Lumi Buddy should not be used as a substitute for secure data storage, official recordkeeping, or professional documentation.

Where supported by the Services, you may review, manage, or delete your AI memory. Additional information regarding how AI memory is collected, stored, and processed is available in our Privacy Policy.

Lumi Buddy may include relationship progression and gamification features designed to enhance user engagement and provide a more interactive experience. These features may include relationship levels, experience points (XP), hearts, badges, achievements, gifts, milestones, and similar virtual features.

Relationship progression is determined by your interactions with the AI and is intended solely for entertainment and personalization purposes. Relationship levels and other progression mechanics do not represent real emotions, personal relationships, or any guarantee of future AI behavior or responses.

All virtual items, rewards, achievements, badges, gifts, and other in-app features have no monetary value, are non-transferable, and cannot be redeemed for cash, goods, or other real-world benefits, unless expressly stated by Lumi Buddy.

We may modify, rebalance, add, remove, or discontinue any gamification or relationship features at any time to improve the Services or maintain a fair user experience.

Lumi Buddy offers both free and paid subscription plans. Certain features, usage limits, and AI capabilities may vary depending on your selected subscription plan.

By purchasing a subscription, you authorize the applicable app store or payment provider to charge the fees associated with your selected plan. Subscription fees, billing cycles, and available plans will be displayed before you complete your purchase.

Unless otherwise stated, paid subscriptions automatically renew at the end of each billing period until canceled. You may manage or cancel your subscription at any time through your account settings or the platform through which you purchased the subscription, such as the Apple App Store or Google Play Store.

Changes to subscription pricing or available plans may occur from time to time. Where required by applicable law or platform policies, we will provide notice before such changes take effect.

Your continued access to paid features is subject to successful payment processing. If a payment cannot be completed, we may suspend or limit access to subscription features until the payment issue is resolved.

All purchases and subscription payments are processed by the applicable third-party platform or payment provider, such as the Apple App Store or Google Play Store.

Unless otherwise required by applicable law, subscription fees and other payments are non-refundable. Refund requests are subject to the refund policies and procedures of the platform through which the purchase was made.

Lumi Buddy does not control, approve, or guarantee the outcome of any refund request processed by third-party payment providers. Users should contact the relevant platform directly for assistance with refund requests.

If a subscription is canceled, you will continue to have access to the applicable subscription benefits until the end of the current billing period, after which your subscription will not renew unless you subscribe again.

You agree to use the Services in a lawful, respectful, and responsible manner. You must not use Lumi Buddy in any way that could harm the Services, other users, or any third party.

When using the Services, you agree that you will not:

• Use the Services for any unlawful, fraudulent, or deceptive purpose.
• Harass, threaten, abuse, or intimidate others.
• Upload, generate, or distribute content that is illegal, defamatory, hateful, violent, discriminatory, or otherwise objectionable.
• Attempt to gain unauthorized access to the Services, user accounts, or related systems.
• Interfere with, disrupt, or impair the operation, security, or integrity of the Services.
• Use automated tools, bots, scripts, or other methods to abuse, exploit, or overload the Services.
• Reverse engineer, decompile, modify, or attempt to discover the source code of the Services, except where expressly permitted by applicable law.
• Use the Services in any manner that infringes the intellectual property or other legal rights of Lumi Buddy or any third party.

Failure to comply with this Section may result in the suspension or termination of your account and may subject you to legal action where permitted by applicable law.

In addition to the requirements set forth in these Terms, you agree not to misuse the Services or engage in any activity that could harm Lumi Buddy, other users, or third parties.

Without limitation, you must not:

• Use the Services to create, distribute, or promote illegal, harmful, fraudulent, or malicious content.
• Use the AI to facilitate scams, phishing, impersonation, identity theft, or other deceptive activities.
• Attempt to bypass, disable, or interfere with the security, safety, moderation, or usage limitations of the Services.
• Exploit vulnerabilities, probe, test, or gain unauthorized access to any part of the Services, servers, or related systems.
• Use the Services to develop malware, viruses, ransomware, or other harmful software.
• Use the Services to violate the privacy, intellectual property, or other legal rights of any individual or organization.
• Circumvent subscription restrictions, payment systems, or access controls.
• Encourage or assist others in engaging in any prohibited activity.

We reserve the right to investigate suspected violations of these Terms and to suspend or terminate access to the Services, remove content, or take any other action permitted by applicable law.

The Services, including but not limited to the Lumi Buddy name, logos, trademarks, software, user interface, designs, text, graphics, images, audio, video, AI technologies, and other content provided by Lumi Buddy, are owned by or licensed to Lumi Buddy and are protected by applicable intellectual property and other laws.

Subject to your compliance with these Terms, Lumi Buddy grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services solely for your personal, non-commercial use.

Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, distribute, modify, publish, sell, license, reverse engineer, create derivative works from, or otherwise exploit any part of the Services without our prior written permission.

You may not copy, imitate, reproduce, or otherwise use the Lumi Buddy name, logo, trademarks, branding, or other distinctive brand elements without our prior written permission. Unauthorized use of our brand assets may violate applicable intellectual property and trademark laws.

Nothing in these Terms grants you any ownership rights in the Services or any intellectual property owned by Lumi Buddy or its licensors. All rights not expressly granted are reserved.

The Services may integrate with, rely upon, or provide access to third-party products, platforms, websites, applications, or services, including but not limited to payment processors, cloud service providers, artificial intelligence providers, analytics providers, authentication services, and app distribution platforms.

Your use of any third-party service is governed solely by the terms, conditions, and privacy policies of the applicable third party. Lumi Buddy does not own, operate, or control these third-party services and is not responsible for their availability, functionality, security, content, or business practices.

We make no warranties or representations regarding any third-party service and disclaim any liability arising from your access to or use of such services. Any interactions, transactions, or disputes between you and a third-party provider are solely between you and that provider, unless otherwise required by applicable law.

If a third-party service becomes unavailable, is modified, or is discontinued, certain features or functionality of the Services may be affected. Lumi Buddy shall not be liable for any resulting interruption, limitation, or loss of functionality.

You may stop using the Services and delete your account at any time, subject to the account deletion options made available through the Services.

Lumi Buddy reserves the right to suspend, restrict, or terminate your access to the Services, with or without prior notice, if we reasonably believe that you have violated these Terms, applicable law, or engaged in conduct that may harm the Services, other users, or third parties.

Upon termination, your right to access and use the Services will immediately cease. Certain information may continue to be retained where required or permitted by applicable law or as described in our Privacy Policy.

Termination of your account does not relieve you of any obligations or liabilities that arose prior to the termination, including any outstanding payment obligations.

The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, Lumi Buddy disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and uninterrupted operation.

We do not guarantee that the Services will always be secure, error-free, uninterrupted, or free from bugs, viruses, or other harmful components. AI-generated content may contain errors, inaccuracies, omissions, or information that is incomplete, outdated, or unsuitable for your particular circumstances.

To the fullest extent permitted by applicable law, Lumi Buddy, its affiliates, directors, employees, partners, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, goodwill, business opportunities, or other intangible losses arising out of or relating to your use of, or inability to use, the Services.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law principles.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved in the competent courts of the applicable jurisdiction, unless otherwise required by applicable law.

Nothing in these Terms shall affect any mandatory consumer rights that may apply to you under the laws of your country or region of residence.

We may revise or update these Terms from time to time to reflect changes in our Services, applicable laws, regulations, technologies, or business practices.

When we make material changes, we will update the “Last Updated” date at the beginning of these Terms and, where required by applicable law, provide additional notice through the Services or by other appropriate means.

Your continued access to or use of the Services after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue your use of the Services.
